THIS LIMITED USE LICENSE AGREEMENT IS A LEGAL AGREEMENT BETWEEN YOU, THE END USER, AND 3DRENDER LTD. BY RECEIVING THE PRODUCT OR INDIVIDUAL IMAGES BY ANY MEANS, ELECTRONIC OR OTHERWISE, YOU AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT.
Title and all copyrights, trademarks and all other conceivable intellectual property rights related to the Product, documentation and any copy made by you are owned by 3dRender Ltd. and are protected by the laws of the United Kingdom, international treaty provisions and all applicable law. Unauthorised copying or transmission to others of the Product or failure to comply with the above restrictions, will result in automatic termination of this license and will make available to 3dRender Ltd. other legal remedies.
This license is not a sale. 3dRender Ltd. grants you the non-exclusive, non-transferable license to use the images contained on it’s downloaded or CDRom/DVD collections (herein called the “Product”) subject to the conditions contained herein. You may not rent, loan, disseminate, publish electronically or by printed media, sell, sublicense, assign, transfer, upload to or download from Torrent or File Sharing websites, or grant any rights to this Agreement or the images contained hereon, or grant rights to any compilation, derivative or collective work containing such images to any other person or organisation without prior written consent of 3dRender Ltd.
You may:
Physically transfer the Product from one computer to another provided the Product is used on only one computer at a time.
Make one copy of the Product for backup or archival purposes.
Install the Product on only one computer at any one time.
Use the Product in a network environment, provided there is only one user accessing the imagery at one time. For multiple users, or multiple office locations in your network, you agree to purchase a Network/Multi-User License. Contact 3dRender Ltd. for details.
You may not:
Sell the Product; rent the Product; lease or lend the Product; publish the Product electronically; distribute the Product by any means including online auction, internet ‘virtual world’ sites, direct mail, retail, Torrent or File Sharing websites, mail order or other means.
Distribute, or permit the distribution of any image or images from the Product on any Torrent or File Sharing websites, internet ‘virtual world’ enterprise, electronic bulletin board, blog, or website as freeware or for a fee, singularly or composite graphic, in any image size or file format, or in any downloadable form.
Sell or distribute any image or images from this Product as stock files, in any size or format, either alone or as part of a digital file library or other product.
Use the Product on more than one computer at a time.
Use the Product on a network where more than one user is accessing the imagery at one time.
Use or permit the use of the images from this Product, or any part thereof, as a trademark or service mark, or claim any proprietary rights of any kind in the images or any part thereof.
Post or permit the posting of any image or images from this Product on any Torrent or File Sharing websites, internet ‘virtual world’ enterprise, electronic bulletin board, blog, or website, even when contained in another product.
Use, or allow any other person to use any of these images from this Product to create pornographic, libellous, obscene or defamatory images. You also may not use these images in a context where printed material states, implies or could be thought to imply something about the image.
Use or permit the use of the images from this Product, or any part thereof, including derivative works, in any product for sale or resale or for use by others, whether or not for sale or resale, without written permission from 3dRender Ltd.
Use or permit the use of the images from this Product, or any part thereof, including derivative works, in advertising.
Otherwise sell, transfer, or grant any rights in the Product in any form to any person. Allow any person to directly interact with the Product in your works, without the prior written consent of 3dRender Ltd. which, if given, is subject to the transferee’s consent to the terms and conditions of this license.
Remove any proprietary notices, labels, or marks on the Product.
Use of an image or images from this Product in a way not covered or specifically prohibited by this Agreement without prior written consent from 3dRender Ltd. is a violation of United Kingdom copyright law and International Treaty provisions.
3dRender Ltd. disclaims all warranties, whether express or implied, including, but not limited to, implied warranties of the merchantability and fitness for a particular purpose with respect to the product. 3dRender Ltd. does not warrant that the operation of the product will be uninterrupted or error free, or that the product will meet your specific requirements and is delivered “as is” and with all faults. Additional statements such as presentations, whether oral or written, do not constitute warranties by 3dRender Ltd. and should not be relied upon.
Warranty on Product shall be limited to replacement of a defective Product only. Verification of original purchase required. For replacement of defective Product contact: 3dRender Ltd. email to: contact@3drender.co.uk.
All refund requests are assessed on an individual basis and at the sole discretion of 3dRender Ltd. Refund requests must be submitted by email within 7 days of original purchase of the Product(s) to: contact@3drender.co.uk. In the event of a refund request acceptance, all copies of Product must be destroyed/deleted with immediate effect.
In no event will 3dRender Ltd. and its distributors, resellers, or agents be liable for any damages, including loss of data, lost profits, lost savings, cost of cover or other special, incidental, consequential or indirect damages arising from the use of the product, however caused and on any theory of liability. this limitation will apply even if 3dRender Ltd., its distributors or agents has been advised of the possibility of such damage. you acknowledge that the license fee reflects this allocation of risk.
This license is in force until it is terminated. If you fail to comply with any terms of this Agreement, your license is automatically terminated, without notice. Upon termination, you must destroy all copies of the Product and documentation in your possession, custody or control.
The user may not sublicense, assign or transfer this Agreement or the Product. This Agreement will be governed by the laws of the United Kingdom. This Agreement is the entire Agreement between us and supersedes any other communications or advertising with respect to the Product. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
